Kevin Spacey testified in court on Monday that he regretted apologizing to actor Anthony Rapp for allegations that the Oscar winner made an unwanted sexual advance on Rapp when he was 14 years old in 1986.
Rapp, now 50, sued Spacey in 2020 for battery and intentional infliction of emotional distress, and testified earlier this month that an inebriated Spacey climbed on top of him at a party at his Manhattan apartment when he was 26 and acting on Broadway.
Rapp, who was just starting out on Broadway at the time, said he was able to "swerve my way out," but the experience scarred him.
U.S. Earlier on Monday, District Judge Lewis Kaplan dismissed Rapp's emotional distress claim but upheld the battery claim.
Spacey testified in his own defense in federal court in Manhattan, saying the allegation was "not true" and that he had never been alone with Rapp. He testified that he was "shocked" when Rapp made his claim public in a Buzzfeed article in 2017.
Following the publication of the article, Spacey issued a statement in which he revealed his sexual orientation and apologized to Rapp for any inappropriate behavior.
Spacey has stated that he now regrets his apology.

Spacey sobbed as he stated that he wanted to do something positive by coming out, but that he was perceived as trying to divert attention away from Rapp's abuse claim.
Rapp, who starred in the Broadway musical "Rent," filed a $40 million lawsuit against Spacey in November 2020.

On Wednesday, Mr. Rapp told the jury that his encounter with Mr. Spacey was the "most traumatic event" of his life.
Mr. Rapp walked the court through the details of his account on Friday, October 14, 2022. He claimed that in 1986 when he was 14, he went to Mr. Spacey's Manhattan apartment for a party and, realizing he didn't know any of the other guests, went into a bedroom and watched television on the edge of the bed.
Mr. Spacey eventually appeared in the doorway, appearing inebriated, and approached him, according to Mr. Rapp.
According to Mr. Rapp, Mr. Spacey then picked him up, describing it as a groom carrying a bride over a threshold, and laid down on top of him, putting his weight on his body and pressing his groin into the side of Mr. Rapp's hip.
Mr. Rapp testified that after wriggling out from under Mr. Spacey, he went inside a nearby bathroom and shut the door before making his way out of the apartment.
Mr. Rapp's attorneys have argued that this account is a battery and that Mr. Rapp experienced severe emotional distress, including depression and anxiety.

Adam Vary, the BuzzFeed journalist who first reported on Mr. Rapp, may testify. One of the defense's key witnesses could be John Barrowman, an actor best known for his role in the television series "Doctor Who."
